Women’s Aid Website Terms of Use
This website, located at www.womensaid.org.uk, and the Members’ Area and Survivors Forum (each as defined below) (collectively, the “Site”) is owned and operated by the Women’s Aid Federation of England, a company limited by guarantee registered in England (registration number: 3171880), whose registered office address is at PO Box 3245, Bristol, BS2 2EH, and a registered charity in England (charity number: 1054154) (“Women’s Aid”, “we” or “us”).
Please read these terms and conditions (“Terms of Use”) carefully before using the Site. You should pay particular attention to the “Disclaimer” and “Limitation of Liability” sections as this excludes or limits our legal liability in connection with your use of the Site. By accessing or using the Site, you agree to be legally bound by these Terms of Use. If you do not wish to be bound by these Terms of Use then you may not access or use the Site. If you breach any of these Terms of Use, we have the right to terminate your access to and use of the Site immediately without notice.
Access to our Site
The Site is designed to allow you to access information, our directory of consultants (if you are registered for access to our [Members’ Area]) and the community site where you can discuss your experiences with other users (the “Survivor’s Forum”).
We cannot guarantee that the Site will operate continuously or without interruptions or will be error free. For this reason, we will not be liable if for any reason our Site is unavailable at any time or for any period. Access to the resources on our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide without notice (see below). You must not attempt to interfere with the proper working of the Site and, in particular or in order to access all or any part of the Site, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, device, server, website, router or any other Internet connected device.
If you are provided with a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. You are responsible for any and all activities that occur under your password or account. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly reset your password.
We have the right to disable any username or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use, or the Member Terms (if applicable).
The information and products shown on the Site are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. If accessing the Site or using of any material or content on the Site infringes any applicable law in your jurisdiction(s), you are not authorised to access or use the Site and you must cease use immediately.
Reliance on information posted
The information resources and forums on our Site are intended for general information purposes only and are not intended to provide specific advice to any user, or legal or medical advice of any kind, and as such you should not rely on any information or advice provided on or through the Site.
Commentary and other materials, including our directory of consultants and on the Survivor’s Forum, posted on our Site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to our Site, or by anyone who may be informed of any of its contents.
Changes to our Site
We reserve the right to update or make changes or corrections to, or alter, suspend or discontinue any aspect of, the Site or the content or services available through it (including but not limited to the Survivors Forum and/or the Members’ Area) at any time in our sole discretion. Unless explicitly stated to the contrary, any new features including new content on the Site (including but not limited to the Survivors Forum and/or the Members’ Area), will be subject to these Terms of Use. By using the Site (or any part of it) you accept that we will not be liable to you or any third party for any changes to or permanent or temporary withdrawal of the Site. If the need arises, we may suspend your access to all or any part of the Site or close all or part of the Site indefinitely. Any of the materials or content made available on the Site may be out of date at any given time, and we are under no obligation to update such material.
Intellectual Property
Materials and content on the Site are protected by copyright laws and other intellectual property rights. We or our licensors are the owner of all intellectual property rights in the Site and any materials or content published or appearing on, or available or distributed through, the Site (including but not limited to all text, graphics, logos, names, artwork, photographs, videos, messages, software and/or code) (collectively, the “Materials”). You may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any Materials available or published on or downloaded from the Site without our prior written consent.
The Women’s Aid name, devices and logos are trademarks and service marks of Women’s Aid (collectively the “Women’s Aid Trademarks”). Other product and service names and logos used and displayed via the Site may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Women’s Aid (collectively, the “Third Party Trademarks”). Nothing in these Terms of Use or the Site should be construed as granting, whether expressly, by implication, estoppel, or otherwise, any license or right to use any Women’s Aid Trade Marks or Third Party Trade Marks displayed or appearing on the Site, without our prior written permission in each instance. All goodwill generated from the use of Women’s Aid Trade Marks will inure to our exclusive benefit.
Under no circumstances will Women’s Aid be liable in any way for any Materials of any third parties (including users of the Site) appearing or published on or available through the Site, including without limitation for any errors or omissions in any such Materials, or for any loss or damage of any kind incurred by you or any other person as a result of the use of or access to any such Materials. You acknowledge that Women’s Aid does not pre-screen Materials, but that Women’s Aid and its designees will have the right (but not the obligation) in their sole discretion to refuse or remove any Materials that are available via the Site. Without limiting the foregoing, Women’s Aid and its designees will have the right to remove any Materials that violate these Terms of Use or the Member Terms (if applicable) or are deemed by Women’s Aid, in its sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, your access to or use of any Materials, including any reliance on the accuracy, completeness, or usefulness of such Materials.
Unless otherwise expressly stated within these Terms of Use or on the Site, no part of this Site or any Materials, Women’s Aid Trade Marks or Third Party Trade Marks appearing on or available via the Site may be (a) copied, published or reproduced; or (b) used for any purpose other than private personal use without the prior written consent of Women’s Aid and/or our licensors (as applicable). All rights (including intellectual property rights) in and to all Materials and/or Women’s Aid Trade Marks and/or Third Party Trade Marks appearing or available on, or comprising or contained within, this Site remains with Women’s Aid or our licensors (as applicable). Any unauthorised use, copying, publication or reproduction of any Materials, Women’s Aid Trade Marks and/or Third Party Trade Marks appearing on or available via the Site is strictly prohibited and constitutes an infringement of intellectual property rights. You acknowledge and agree that any Materials, questions, comments, suggestions, ideas, feedback or other content or information published by you on, or submitted to you via, the Site, including the Members’ Area and the Survivor’s Forum (“Submissions”), are non-confidential and you hereby grant to Women’s Aid a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable and unrestricted licence to use, copy, reproduce, modify, publish and disseminate these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Women’s Aid has made reasonable efforts to ensure that the contents of this Site are accurate and up-to-date. However, we do not represent, warrant or guarantee that the content on our Site, including without limitation any Materials, are accurate, complete or up-to-date. We also do not warrant or represent that the information or materials (including without limitation the Materials) available on or through the Site will meet your particular requirements or needs or that access to, or use of, the same will be uninterrupted or completely secure. The information contained in the Site, including without limitation any Materials, may contain inaccuracies or errors. We are not required to update the Site or to correct any inaccuracies which may become apparent, but will be entitled to do so is we wish without notice to you.

Limitation of Liability
You expressly understand and agree that, to the extent permitted by law, Women’s Aid will not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for direct or indirect loss of profits, or loss of goodwill, use, data or other intangible losses (even if Women’s Aid has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the access to or use of or the inability to access or use the Site and/or any of the Materials, Women’s Aid Trade Marks, Third Party Trade Marks or other information or services made available through the Site; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Site; or (iv) any other matter relating to the Site.
In no event will Women’s Aid’s total liability to you for all damages, losses or causes of action suffered or incurred by you or any other person, whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the access to or use of or the inability to access or use the Site and/or any of the Materials, Women’s Aid Trade Marks, Third Party Trade Marks or other information or services made available through the Site; (ii) unauthorized access to or alteration of your Submissions, transmissions or data; (iii) statements or conduct of any third party on the Site; or (iv) any other matter relating to the Site and/or the Materials, exceed [one hundred pounds (£100)]. Where our Site contains links to websites and resources provided by third parties, these links are provided for your information only. When you access any other website you understand that it is independent from us and that we have no control over the contents of those websites or resources, and accept no responsibility for the availability, accuracy or content of these websites or resources or for any loss or damage that may arise out of your use of them. Live Chat
Your chat is confidential. You do not have to tell the support worker anything you don’t want to, and you do not have to give your name or location. Our Live Chat service is designed for privacy and we do not have access to IP addresses for chats unless we have a serious safeguarding concern. Data protection and privacy
Any membership data, registration data, data your include about yourself in the Survivor’s Forum, including any Materials you submit via the Survivors’ Forum, and certain other information about you are governed by our Privacy Policy.
Linking to our Site
You may link to our Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.
Indemnity
You agree to indemnify and hold Women’s Aid and its affiliates and their officers, employees, directors and agents (collectively, “Indemnitees”) harmless from any from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Site, your connection to the Site, any Materials or Submissions you upload or submit via the Site, your violation of these Terms of Use or your violation of any rights of another. Notwithstanding the foregoing, you will have no obligation to indemnify or hold harmless any Indemnitee from or against any liability, losses, damages or expenses incurred as a result of any action or inaction of such Indemnitee.
General
These Terms of Use contain the entire agreement between us and you with respect to their subject matter. A person who isn’t a party to these Terms of Use has no rights under them, whether under the Contract (Rights of Third Parties) Act or otherwise. If either we or you have any right to enforce these Terms of Use against the other, that right will not be lost even if the person who has the right delays enforcing it or waives their right to enforce it in any instance. If a court or other authority decides that any part of these Terms of Use is illegal or ineffective, the rest of the terms will be unaffected and will remain in force.
Jurisdiction and applicable law
These Terms of Use, Members’ Area Terms and Survivors Forum Terms and any dispute or claim arising out of or in connection with them or their subject matter, whether of a contractual or non-contractual nature, are governed by and construed in accordance with English law. You can bring legal proceedings in relation to any access to or use of our Site (including without limitation the Materials, Survivors’ Forum and/or the Member’s Area) or these Terms of Use, the Members’ Area terms or the Survivors Forum Terms, in the English courts or your local courts, if you reside outside England and Wales.
The Site has been approved for access in the United Kingdom. We cannot give any assurances that the Site, use of the Site (including the Survivors’ Forum and the Member’s Area) or these Terms of Use, Members’ Area Terms & Conditions and Survivors’ Forum Terms & Conditions (in each case, in whole or in part) are in compliance with laws or available for use in locations outside the United Kingdom. If you choose to access the Site from locations outside the United Kingdom, you do so at your own initiative and risk and are responsible for compliance with local laws.
Complaints procedure
Please send all complaints to the moderator via the email address, survivors-forum@womensaid.org.uk Any user posting complaints on the Survivors Forum instead of following the Complaints Procedure will be deemed to have breached the Terms of Use and will risk having their account closed.
Advice about your legal rights is available from the Citizens Advice website. Nothing in these Terms of Use will affect your rights at law.
Changes to these Terms of Use
We may change or replace these Terms of Use at any time, without prior notice to you, by posting changes online. We recommend that you check these Terms of Use from time to time and take notice of any changes we have made, as they are binding on you. Certain provisions of these Terms of Use may be amended or superseded by legal notices or terms located on particular pages of the Site or on materials that are downloadable from the Site. Continued use of the Site (or any part of it) after changes to these Terms of Use are posted means you agree to be legally bound by the latest published version of the Terms of Use. If you do not agree to any change to the Terms of Use then you must immediately stop using the Site.
